DUI court: a helpful alternative for DUI charges

People make mistakes all the time, and in some instances, those mistakes result in strong consequences. This is particularly true in cases where people face DUI charges

Thankfully, in some situations, there are alternatives, such as DUI court. For those encountering DUI charges, it may be helpful to be aware of a few factors.

The program

The Oklahoma DUI and Drug Court Program provides certain parties with DUI convictions with an alternative opportunity to try to overcome their addiction and transition back into society. The program usually lasts between 18 to 24 months, depending upon the needs of the party. While in the program, people must participate in group and individual counseling sessions, as well as check in with the judge each week. There are also random drug tests on occasion, which the participant must pass.

If the individual has a relapse, it is up to the judge's discretion to determine whether to extend the time in the program or to send him or her to prison. For those who successfully complete the program, the court evaluates whether the participant is ready and able to transition back into society.

Qualifying factors

There are certain stipulations that people must meet in order to qualify for the DUI court program. The main qualification is the type of charge the party faces. In order to qualify for the program, a candidate must be facing a federal DUI charge, and usually, it needs to be a repeat offense. However, some counties may accept first-time offenders. There must be a pattern to show that the DUI stems from an addiction that warrants treatment rather than incarceration.

This is a brief overview of the DUI court program. Lawmakers have instituted these programs across the United States, and they have had great success. For those facing DUI charges who would like to see if DUI court is an option in their case, it may be beneficial to review the program in full and follow proper procedure to request it.
