Saving your driving privileges after a DUI

Driving under the influence is a serious matter. A DUI can have massive effects on the lives of people who encounter such charges. However, there are ways to protect certain privileges.

For those who face a DUI charge, it is important to understand the process and what all it entails. Especially for those trying to save their driving privileges, there are a few key things to know.

Upon Arrest

At the time of a DUI arrest, the officer usually takes the driver's license and issues a temporary license that is good for 30 days. Sometimes, drivers may be able to retain their licenses if they submit to a blood test at the officer's request. Either way, the driver has 15 days to request an administrative hearing.

Charges

When motorists receive a DUI charge, they face two different legal actions. One is a criminal charge for the crime itself, and the other is a civil action against the person's driving rights. The administrative hearing is essential to protecting the driver's rights. The Oklahoma Department of Public Safety hears the civil case and determines the motorist's rights. However, if people do not request a hearing in the 15-day allotment, they waive their right to a hearing and the department revokes their driving rights.

After Arrest

After the arrest, you can either submit for a hearing or have an attorney do it for you. Either way, make sure you retain proof of the submission in case it becomes lost. If the department claims not to have your request, you may receive a lengthy license suspension. To avoid this and other hiccups, make sure you follow proper protocol for the hearing proceedings.

As you can see, saving your driving privileges does require a few key things. Make sure you fully understand what all to expect and try to prepare yourself accordingly.
