Bid Protests In State Work Contracts

The government hires out various companies for a range of contract jobs, from construction to fingerprinting services and a variety of products. The process for a company obtaining a government contract for services and products is complex and heavily regulated. The Bid Process

The process for government bids generally proceeds like this:

  • Request for proposal: When the state wants to hire out a company for goods or services, it will publish a request for proposal (RFP).
  • Public bidding: After the RFP, the state will receive bids from companies interested in the work.
  • Evaluation and award: The state will then evaluate the bids and award one company the job.

Protesting A Bid

Not surprisingly, the evaluations are not competitive. Companies can protest contract awards that seem to be awarded unfairly. The first step is to open a records request to look over all of the bids and evaluations.

In cases where evidence of foul play is uncovered, we file a formal protest of the contract with the Office of Management and Enterprise Services.
